These Terms & Conditions (“Terms”) constitute a binding agreement between Capablanca Chess School Pvt. Ltd. (“Company”, “we”, “us”) and the user (“you”, “parent/guardian”). By registering, paying, or accessing our website or services, you agree to these Terms along with our Privacy Policy and Cancellation & Refund Policy.

1. Eligibility and Accounts

  • Only individuals above eighteen (18) years of age who are parents or legal guardians may create accounts.
  • By registering, you warrant and confirm that you are the lawful parent/guardian of the student and consent to the processing of the student’s personal data and class recordings.

2. Services and Recordings

  • The Company provides online chess coaching and organizes offline tournaments.
  • All online classes are recorded. Session recordings will be shared only to the student and his/her parents/guardians upon request.
  • The Company reserves the right to photograph the events and use the same for marketing/promotional activities as well as for documentation.

3. Payments

  • All fees are payable in advance.
  • Payments are processed via payment aggregators; no card/bank details are stored by the Company.
  • Fees are strictly non-refundable, except as expressly provided in the Cancellation & Refund Policy.

4. Conduct

You agree not to:

  • disrupt classes or tournaments;
  • engage in abusive, unlawful, or harmful conduct;
  • copy, share, or redistribute recordings or materials without express permission.

5. Intellectual Property

All course materials, photographs, videos, recordings, graphics, and trademarks are the property of the Company. Any unauthorised sharing, distribution or dissemination of such property shall render you liable for damages.

6. Limitation of Liability

Services are provided on a best-efforts basis without warranties as to specific outcomes. The company shall have no liability towards the performance of the student.

7. Indemnity

You agree to indemnify and hold the Company harmless from any claims arising out of your misuse of the Services or breach of these Terms.

8. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Courts at Thiruvananthapuram, Kerala, shall have exclusive jurisdiction.

9. Changes

The Company reserves the right to amend these Terms at any time. Continued use of Services constitutes acceptance of such amendments.
